Welcome to Wettra.shop and the Wettra mobile app (collectively referred to as “Wettra,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your use of our website, mobile applications, services, and any other online platform we operate (the “Services”).
By accessing or using Wettra, you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, please stop using our Services immediately.

2. Eligibility
You may use Wettra only if:

  • You have the legal capacity to enter into a binding agreement.
  • You agree to use the platform for lawful purposes only.

4. Our Services
Wettra is a fashion marketplace platform that connects buyers and sellers of pre-owned and new fashion items (clothing, shoes, accessories). Wettra is not the seller of any items listed by users and acts only as an intermediary facilitating transactions.

5. User Responsibilities
When using Wettra, you agree that you will not:
  1. Sell counterfeit, illegal, stolen, or harmful goods.
  2. Misrepresent the quality or authenticity of your items.
  3. Use offensive, abusive, or fraudulent behavior towards other users.
  4. Attempt to hack, interfere with, or disrupt our platform.
  5. Upload content that infringes on intellectual property rights.
Violation of these rules may result in suspension or permanent account termination.

6. Transactions and Payments
  • Payments are processed via third-party payment gateways such as Stripe or PayPal.
  • Wettra charges a small commission fee on successful sales (the “Service Fee”). The fee will be displayed before you finalize your listing or purchase.
  • Wettra is not responsible for any disputes between buyers and sellers but may mediate when necessary.

7. Shipping and Delivery
  • Sellers are responsible for shipping sold items promptly and providing accurate tracking information.
  • Buyers must confirm delivery within the app once they receive the product.
  • Funds will be released to the seller only after the buyer confirms receipt or after the designated protection period has passed.

8. Refunds and Disputes
  • Refunds are not automatically guaranteed and depend on the seller's policy and proof of the issue (e.g., receiving counterfeit or damaged goods).
  • Disputes must be reported within 48 hours of delivery confirmation. Wettra will review and mediate disputes but is not liable for direct refunds unless explicitly stated.

9. Intellectual Property
  • All Wettra content, including logos, text, graphics, and software, is owned by NIXON PROBUILD CONSTRUCTION LTD. or its licensors.
  • You may not copy, modify, distribute, or create derivative works without our written consent.

10. Privacy
Your use of Wettra is also governed by our Privacy Policy, which explains how we collect, store, and protect your data.

11. Prohibited Activities
You agree not to:
  • Use automated systems (bots, crawlers) to scrape data.
  • Post spam, scams, or fraudulent listings.
  • Misuse promotional offers, discounts, or referral programs.
  • Create multiple accounts to manipulate ratings or sales.

12. Termination of Use
Wettra reserves the right to:
  • Suspend or terminate any account that violates these Terms.
  • Remove or edit content that breaches our policies or is harmful to our community.

13. Disclaimer of Warranties

  • We do not guarantee that the platform will be error-free, uninterrupted, or secure at all times.
  • We are not responsible for the quality, authenticity, or legality of items listed by users.

14. Limitation of Liability
To the maximum extent permitted by law:
  • Wettra and NIXON PROBUILD CONSTRUCTION LTD. are not liable for indirect, incidental, or consequential damages arising from the use of our Services.
  • Our total liability, if any, shall not exceed the total Service Fees you paid to Wettra during the 3 months prior to the claim.

15. Indemnification
You agree to indemnify and hold harmless Wettra, NIXON PROBUILD CONSTRUCTION LTD., and its employees from any claims, damages, or liabilities resulting from your use of our Services, your content, or your violation of these Terms.

16. Governing Law
These Terms are governed by:
  • Canadian law (for users in Canada).
  • Applicable U.S. state and federal law (for users in the USA).
Any disputes shall be resolved in the courts of British Columbia, Canada.

Wettra reserves the right to update or modify these Terms at any time. We will post changes on this page and update the “Effective Date.” Continued use of our Services constitutes acceptance of the updated Terms.
